STATE .... Respondent Through:
Mr. Tarang Srivastava, APP for the State.
CORAM:
HON'BLE MR. JUSTICE ANUP JAIRAM BHAMBHANI
O R D E R
% 13.08.2020 The applicant was granted interim bail for 01 month by order dated 18.06.2020 made by the learned Sessions Judge. The interim bail was further extended by 15 days by order dated 20.07.2020. Thereafter however, by order dated 04.08.2020 the learned Sessions Judge has rejected the plea for further extension. 2.
On being queried, Mr. Kamal Jindal, learned counsel for the applicant submits that in his application dated 27.07.2020 seeking further extension of interim bail it was pleaded and argued that extension was sought on the basis of order dated 13.07.2020 made by a Full Bench of this court in W.P.(C) No.3037/2020 titled Court on its own Motion vs. State & Ors., whereby interim bail orders, such as the one granted to the applicant, stood extended till 31.08.2020. In spite thereof, the learned Sessions Judge has declined such extension. Bail Appl. 2052/2020 Page of
3.
From a perusal of bail application dated 27.07.2020 it appears that the binding order dated 13.07.2020 made by the Full Bench, as further clarified by order dated 24.07.2020, in W.P.(C) No.3037/2020 titled Court on its own Motion vs. State & Ors., has been placed before the learned Sessions Judge as 'guidelines', which may have been the reason for the Sessions Judge to decline extension. 4.
In view of the above, Mr. Jindal wishes to withdraw the present application, with liberty to file a fresh application seeking extension of interim bail, alongwith copies of the Full Bench orders dated 13.07.2020 and 24.07.2020 as also the present order, before the learned Sessions Court for consideration.
5.
Accordingly, the present application is dismissed as withdrawn, with liberty as prayed.
6.
Pending applications, if any, stand disposed of. ANUP JAIRAM BHAMBHANI, J.
