The present petition has been filed by the petitioner seeking a direction against the respondent to issue the death certificate of petitioner's wife late Smt. Sunita.

Learned counsel for respondent/MCD who appears on advance notice informs that the impediment as regards issuance of the said death certificate is that the cremation slip is not available with the petitioner. Further, the application for issuance of death certificate was filed belatedly, even though the petitioner's wife is stated to have died on 17.03.2016. 3.
After some hearing, learned counsel for respondent submits that the petitioner may approaches the SDM, as contemplated under Section 13(3) of the Registration of Births and Deaths Act, 1969, under which, the SDM would carry out the necessary inquiry and issue a certificate, pursuant to which, it shall be open to the petitioner to make another online application for issuance of death certificate.

Let the petitioner approach the SDM within a period of one week from today whereupon the SDM shall conduct necessary inquiry and furnish a report/certificate within a period of 4 weeks thereafter. 5.
Learned counsel for MCD assures that as and when such a fresh online application is submitted pursuant to the aforesaid inquiry to be conducted by the SDM. The same would be processed expeditiously and without insisting on the cremation slip of the petitioner's wife. 6.
With the aforesaid direction, the present petition alongwith all the pending application/s stands disposed of.
