The present petition has been filed under Section 482 Cr.P.C. seeking quashing of FIR No.294/2011 under Section 287/338 IPC, registered at Police Station Okhla Industrial Area and all consequential proceedings emanating therefrom, on the ground that the parties have arrived at a settlement.

Issue notice. Mr. Tarang Srivastava, learned APP for the State accepts notice. He submits that since the parties have arrived at a settlement, the State has no objection in case the FIR in question is quashed. 3.
The petitioner is present in Court and respondent no.2 appears through VC. They have been identified by their respective counsels as well as by the Investigating Officer SI Anil Kumar, PS-Okhla Industrial Area. The case of the prosecution as articulated in the present petition is that an FIR was registered at the instance of respondent no.2/complainant who alleged that he was working in the factory of petitioner and while working in the factory on 26.09.2011, he received injuries due to an accident that took place in the factory.

During the pendency of the proceedings, the parties have resolved all their disputes amicably without any coercion or pressure and arrived at a settlement, the terms whereof have been reduced in writing in the settlement agreement dated 27.07.2017, which is annexed as Annexure-P-9 to the present petition. In terms of the settlement, petitioner has agreed to pay a sum of Rs.1,60,000/- towards full and final settlement, which has been paid to respondent no.2.

On being queried by the Court respondent no.2/complainant states that he has settled the matter with petitioner and has received the entire settlement amount. Therefore, he has no objection, in case the FIR in question is quashed.

In view of the fact that petitioner as well as respondent no.2 have amicably settled their disputes and regard being had to the statement made by complainant, this Court is of the view that no useful purpose will be served in continuation of criminal proceedings and it will be an exercise in futility.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 9.
Consequently, the petition is allowed and the FIR No.294/2011 under Section 287/338 IPC, registered at Police Station Okhla Industrial Area alongwith all other proceedings emanating therefrom, is quashed. The petition stands disposed of in the above terms. 11.
