% 05.02.2018 After some hearing, the counsel for the petitioner submits that he may be allowed to withdraw the present petition and the accompanying application and given liberty to move an application for amendment of the plaint in that the existing pleadings are not forthcoming as to the history of the title acquired by the plaintiff and in light of orders passed on such application to move a fresh application for submitting on record copy of the Partition Deed.

The petition and the application are dismissed as withdrawn with liberty, as prayed, granted.
