The petition seeks directions against respondent no.2 to stop the alleged illegal and unauthorized construction and illegal cutting/felling of the tree on the plot no.A-347, Phase 2, Chhatarpur Enclave. Opp. Mahavir Mega Mart, New Delhi.

The Court vide order dated 23.04.2024 directed the issuance of notice to the respondents. Thereafter, various directions were passed, including to direct the respondent-MCD to place on record the inspection report. Paragraph no.5 of the order dated 21.05.2025 is extracted as under: "5. In the meantime, the MCD is directed to carry out a fresh inspection of the property and ensure that any subsisting unauthorized construction is removed."

Learned counsel appearing for the respondent-MCD submits that the fresh inspection report has been filed, however, the petitioner controverts the same. He submits that no action has been taken by the respondent-MCD and reconstruction is persisting and rights of third-parties are being created by the builder/owner.

If that be so, the petitioner would be permitted to approach the Special Task Force ['STF'], which is constituted as per the direction of the Supreme Court. If the petitioner approached the STF, let the grievance of the petitioner be immediately looked into, and appropriate directions be passed. 5.

All rights and contentions are left open.

Petition stands disposed of. Pending applications also stand disposed of.

If the petitioner feels that any unauthorized construction is being raised on any other plot, other than plot no.A-347, Phase 2, Chhatarpur Enclave, the petitioner shall be at liberty to raise the grievance before the STF.
