% 07.08.2020 The petitioner has prayed for quashing of FIR No. 38/2010 registered under section 3 of the West Bengal Prevention of Defacement of Property Act 1976 at PS: Jama Masjid, allegedly for defacement of public property. At the outset, Mr. Avninder Singh, learned Additional Standing Counsel for the State submits that the subject FIR was in fact filed under the Delhi Prevention of Defacement of Property Act 2007; however, the Magistrate has declined to take cognizance of the offence. In view of the statement made by Mr. Singh, counsel for the petitioner seeks leave to withdraw the present petition. Accordingly, the present petition is dismissed as withdrawn.
