W.P. (Crl.) 1202/2020 The petitioner is on interim bail granted vidé order dated 25.06.2020 in Bail Appl. No.1371/2020 for 45 days. The interim bail granted expires 13.08.2020.

Mr. Kedar Yadav, learned counsel for the petitioner submits that upon approaching the Jail Superintendent prior to the date of surrender, citing orders dated 13.07.2020 and 24.07.2020 made by a Full Bench of this court in W.P.(C) No.3037/2020 titled Court on its own Motion vs. State & Ors. the petitioner was told that he would not W.P. automatically be entitled to the benefit of extension of interim bail on the basis of those orders; and that he should obtain a specific order from the court for such extension.

Mr. Ranbir Singh Kundu, learned ASC appears for the State on advance copy; and submits that there is some miscommunication in the matter, since the jail authorities are duty-bound to give benefit of the Full Bench orders to inmates who are inter alia on interim bail. 4.

Accordingly, the present petition is disposed of, clarifying that the petitioner is also entitled to extension of interim bail by operation of orders dated 13.07.2020 and 24.07.2020 made by the Full Bench in W.P.(C) No.3037/2020 upto 31.08.2020 on the same conditions as imposed earlier.
