By virtue of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of interim bail for a period of 90 days in proceedings arising out of FIR No. 1583/2015 dated 25.08.2015, registered at PS.: Mangol Puri, Delhi, under Sections 302/120-B/34 of the Indian Penal Code, 1860 (IPC) read with Sections 25/27 of the Arms Act, 1959.

presence of the applicant to provide physical and emotional support to his wife. He further submits that the medical condition of the applicant's wife remains critical, which is supported by medical documents and the said position has been duly verified by the State, thus the applicant be granted interim bail.

Per contra, learned APP for the State relying upon the Status Report opposes the grant of interim bail to the applicant. He submits that though the medical documents of the applicant's wife have been verified, however, considering that the applicant is hard-core criminal with history of running notorious gangs, his involvement in as many as/ more than twenty (20) criminal cases as also since he falls under the category of high-risk prisoners, there is a grave apprehension that, if enlarged on interim bail, the applicant as also his associates will make all efforts to facilitate an escape from the due process of law. 4.
Considering the overall facts and circumstances of the present case, this Court is not inclined to grant interim bail to the present applicant at this stage.

However, at this stage, learned senior counsel for the applicant, on instructions, submits that without prejudice to the right and contentions of the applicant, bearing in mind the grave medical urgency involved herein, the request, at the moment, may be confined to grant of custody parole. 6.
In light of the aforesaid, since the medical condition of the applicant's wife is critical as per the medical records, which has also been verified by the learned APP and to balance the equities as also taking a humanitarian view, this Court deems it appropriate to grant custody parole to the applicant for a period of two days i.e. 05.06.2026 and 06.06.2026. Accordingly, the concerned Jail Superintendent is directed to make adequate security arrangements, particularly, keeping in mind the status of the present applicant, who is a high-risk undertrial, to ensure that he is in a position to meet his ailing wife at Nurture IVF Centre, B-125, Naraina Vihar, New Delhi-110028 on 05.06.2026 and 06.06.2026 between 10:00 a.m. to 4:00 p.m.

During such custody parole, the applicant would only be permitted to meet his ailing wife and to consult the concerned doctor(s). 9.
As such, the present application is disposed of in the aforesaid terms.
