The present petition has been filed by the Petitioner- Rakesh Kumar Gupta under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondents to permit the Petitioner to participate in the survey conducted by Town Vending Committee (hereinafter, 'TVC').

The case of the Petitioner is that he claims to be an existing vendor, who was vending near Regal Building, Connaught Place, New Delhi (hereinafter, 'site') for several years. challans which have been filed by him as evidence to establish the fact that the Petitioner has been vending at the said site prior to the enactment of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014. The Petitioner has been removed from the site of vending in 2021, when the said area was declared as a 'No Vending Zone'. According to the Petitioner, the survey of the New Delhi Municipal Council (hereinafter, 'NDMC') has been commenced and he just wishes to participate in the said survey.

Mr. Raj Kumar, Additional Standing Counsel for the NDMC, submits that the survey is undergoing at the moment.

Accordingly, it is directed that the Petitioner shall firstly produce all the documents before the TVC and upon verification of the Petitioner's credentials, the Petitioner shall be permitted to participate in the said survey. 7.

The petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
