The present petition under Section 439 CrPC seeks regular bail in FIR No.13/2019 under Sections 392/34 IPC registered at P.S.Patparganj Industrial Area.

A perusal of the record shows that the petitioner had preferred a similar bail application before the learned Additional Sessions Judge(ASJ), which was dismissed as withdrawn on 24.06.2020. In these circumstances, it has been put to the learned counsel for the petitioner, as to how the present petition would be maintainable. 3.

After some arguments, learned counsel for the petitioner submits that the petitioner will be once again approaching the learned ASJ and, therefore, seeks leave to withdraw the present petition. 4.

The petition along with pending application stands dismissed as withdrawn.
