By way of the present petition, the petitioner seeks quashing of the FIR bearing No. 871/2022, registered at Police Station New Usmanpur, Delhi, for the commission of offences punishable under Sections 376/376(2)(n)/313/506 of the Indian Penal Code, 1860 (hereafter 'IPC') and all consequent proceedings emanating therefrom on the basis of settlement arrived at between the parties.

Brief facts of the case are that on 22.09.2022, the FIR in this case was registered on the complaint of the complainant against the petitioner under relevant sections of law. The complainant was medically examined and her statements under Sections 161/164 of Cr.P.C. were recorded. The petitioner was arrested on 04.10.2022 and investigation was carried out, during which supplementary statements of the complainant and her mother were recorded. It is stated that the main chargesheet under Sections 376/377/313/506 of IPC was filed on 25.11.2022, followed by a supplementary chargesheet on 11.03.2024. Charges under Sections 376/376(2)(n)/313/506 IPC were framed on 18.07.2024. Thereafter, the petitioner and respondent No. 2 solemnized their marriage on 10.04.2026 and had amicably settled their dispute vide Settlement Agreement dated 08.05.2026. 7.
On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed. 8.
The complainant and the petitioner are related to each other and since earlier the petitioner had refused to get married, the present FIR was registered. Now the parties have got married on 10.04.2026 and the Nikahnama is on record.

In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 10.
Accordingly, FIR bearing No. 871/2022, registered at Police Station New Usmanpur, Delhi, for the commission of offences punishable under Sections 376/376(2)(n)/313/506 of IPC and all consequential proceedings emanating therefrom are quashed.
