The petition is for the following reliefs:
"a. Pass an appropriate writ in the nature of mandamus or any other appropriate writ or, order or direction, directing the respondents to refer the dispute between parties to a 3-member committee as per the provision of clause 18.1.1.(ii) of the general condition of contract in tender for "providing and laying HDPE internal sewer line in Pulprahladpur, Vishwakarma Colony, Chungi number 3 and Lal Kuan, New Delhi" in May 2013 so that the dispute regarding payment of outstanding amount of Zipl in respect of the said tender can be settled; b. Pass such other further direction as this Hon'ble Court may deem fit and proper in the facts of the case."

It is the case of the petitioner that as per the Clause 18.1(ii) of the General Conditions of Contract between the petitioner and the respondent no.2, if any dispute arises and in case of failure to amicably resolve, the same has to be referred to three member body consisting of Chief Secretary of the Government of NCT of Delhi or his representative, as Chairman, the Chief Executive Officer of the DJB, and a nominee representative of the Contractor for amicable settlement (hereinafter 'the Committee'). 5.
The petitioner, thus, submits that the dispute has arisen and even an application has been sent to respondent no.2 for referring the matter to the Committee, however, the respondent has not acted upon. 6.
It appears that the relief prayed in the instant writ petition since relates to sending the matter to the Committee, the petition, therefore, can be disposed of with the directions to the respondents to consider the same and to furnish appropriate response within a period of 45 days from the date of receipt of a copy of this order passed today. 7.
If the dispute is liable to be sent to the Committee, let the appropriate decision be taken, and if for any reason, the respondents are not agreeable, they are directed to assign the reasons for the same. 8.
With the aforesaid directions and observations, the petition stands disposed of.
