The petition is for the following reliefs:

"a) Issue a writ of mandamus, order or direction directing Respondent Nos. 1 to 4 to ensure that footpaths to be free from encroachment outside the establishments of Respondent Nos. 5, 6 and 7; b) Issue a writ of mandamus or any other appropriate writ, order or direction directing Respondent Nos. 1 to 4 to take appropriate legal action against Respondent Nos. 5, 6 and 7 for violations of law; c) Issue a writ of mandamus or any other appropriate writ, order or direction directing Respondent Nos. 1 to 4 to regularly monitor and regulate the activities of Respondent Nos. 5, 6 and 7 in accordance with law;"

for removal of the encroachment. He further prays for the directions to respondent nos. 1 to 4 to take legal action against private respondents on account of alleged nuisances as has been stated in the writ petition. 3.

The Court finds that the petitioner has a remedy under Section 152 of the Bharatiya Nyaya Sanhita (BNS), 2023 to approach the jurisdictional District Magistrate. Additionally, the petitioner can also point out his grievance before the concerned Municipal Corporation or other authorities. 4.

If the petitioner does so, let the petitioner's grievance be taken to its logical conclusion with due expedition not beyond four weeks from the date of receipt of a copy of the representation/ application. 5.

With the aforesaid directions and observations, the petition stands disposed of.

If the grievance of the petitioner is not mitigated, he shall be at liberty to take appropriate recourse in accordance with law.
