The petitioner, on whose complaint, FIR No. 104/2016 under Sections 420/468/467/471/120B of the Indian Penal Code, 1860 was registered at Police Station Economic Offences Wing, has filed the present petition being aggrieved that despite the fact that the chargesheet was filed for the first time in the year 2019, the charges are yet to be framed.

The petitioner also claims that pursuant to filing of supplementary chargesheet, he had filed an application under The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Section 173(8) of the Code of Criminal Procedure, 1973, pointing out certain relevant factors which were not considered by the Investigating Agency. The said application was also filed way back in the year 2022 and the same is stated to have not been decided as yet.

Undisputedly, the FIR was registered way back in the year 2016. The learned counsel for the petitioner submits that the matter is still pending at a preliminary stage and the petitioner who is now 69 years of age and suffering from various ailments, may not even survive to give his evidence.

The petitioner prays that the learned Trial Court be directed to expedite the conclusion of trial in the present matter. 7.

Considering the aforesaid submissions, the present petition is disposed of with directions to the learned Trial Court to expedite the proceedings in CR Case No. 9983/2019 arising out of FIR No. 104/2016.

The learned Additional Standing Counsel for the State fairly submits that the concerned Investigating Officer would be sensitized and it will be ensured that no unwarranted adjournments are taken at the behest of the State. 9.

The learned Trial Court is requested to not grant any unwarranted adjournments to any of the parties and proceed further with the matter.
