The petitioner has filed the present petition, inter alia, seeking interim bail for a period of sixty days in FIR No. 621/2015 under Sections 364A/120-B/368/34 of the IPC registered with PS Uttam Nagar on the ground that his niece, who is aged about nine years, is critically ill. 4.
The allegation against the petitioner is that he, in conspiracy with other co-accused, had kidnapped a child for ransom. 5.
Ms Rajni Gupta, learned APP appearing for the State states that the material witnesses are yet to be examined. She also points out that the interim bail application (BAIL APPLN. 1707/2020) of co-accused was Signed By:DUSHYANT RAWAL Location:

dismissed on 30.07.2020. In addition, she submits that although it is stated that the petitioner's niece is critically ill, no medical documents indicating the same have been filed. Further, there are other members of the family who can look after the petitioner's niece.

Since the charge against the petitioner is of conspiracy and commission of an offence of kidnapping for ransom, the petitioner does not qualify the criteria as set out by the High Powered Committee in its order dated 18.05.2020 (which was clarified by another meeting dated 20.06.2020) 7.
