% 12.02.2026 I.A. 3739/2026 (by plaintiff under Section 151 CPC seeking withdrawal of suit) 1.

By way of present application, the plaintiff seeks to withdraw the present suit.

Mr. Bharat Arora, learned counsel appearing on behalf of the plaintiff, on instructions from the plaintiff, who is present in Court, submits that during pendency of the present suit, the parties were referred to mediation, where they have arrived at a settlement, terms whereof have been reduced in writing in the form of Settlement Agreement dated 03.02.2026, which is filed along with the present application.

In terms of the said settlement, the defendant has handed over a demand draft in the sum of Rs.2 crores issued by HDFC Bank in the name of the plaintiff i.e. Mr. Anup Singh Dhindsa, who is present in Court. 5.

In view of the above, the plaintiff seeks to withdraw the present suit. 6.

Mr. Krishnan, however, points out that during pendency of the suit, the defendant had deposited a sum of Rs.97,000/- with the Registrar General of this Court in terms of order dated 02.03.2023. 7.

He submits that since the suit has been settled, the said amount may be refunded to the defendant, to which Mr. Arora, on instructions from the plaintiff, states that he has no objection.

Accordingly, the Registry is directed to refund the amount, if any, deposited by the defendant along with interest accrued thereon. 9.

The suit is dismissed as withdrawn.

All undertakings given by the defendant in terms of order dated 08.03.2022 also stand discharged.
