O R D E R

% 12.01.2024 Mr. Gurinder Pal Singh, learned counsel appearing for the petitioner seeks leave to withdraw the present petition under section 9 of Arbitration & Conciliation Act 1996 ('A&C Act'), with liberty to place the same petition as an application under section 17 of the A&C Act before the learned Sole Arbitrator who has been appointed in the matter vide order dated 09.01.2023 in ARB. P. No. 902/2023.

Mr. Singh further prays that till such time as the learned Sole Arbitrator takes a view on the application under section 17 of the A& C Act, the operation of order dated 30.05.2023 made in the present proceedings whereby some interim relief was granted to the petitioner be continued. In view of the above, the present petition is disposed-of as withdrawn, permitting the petitioner to place before the learned Sole Arbitrator, the present petition as an application under section 17 of the A&C Act with a request to the learned Sole Arbitrator to decide the same as expeditiously as possible, in accordance with law.

It is further directed that the interim order granted vide para-10 of order dated 30th May 2023 shall continue until such time as the application under section 17 of the A&C Act is decided by the learned Sole Arbitrator.
