O R D E R

% 18.01.2017 Learned counsel for the petitioner submits that the respondent has deposited a sum of Rs.93,200/- under the Amnesty Scheme of the Department of the year 2016-2017; she has placed on record a communication dated 09.01.2017 addressed by the respondent to the Joint Assessor and Collector of the petitioner Department. Learned counsel for the petitioner submits that this sum of Rs.93,200/- is the principal amount in terms of assessment order dated 16.04.2003 and arrears up to 31.03.2004 stand cleared. The communication of the respondent further communicates to the petitioner that he is no longer interested in pursuing this litigation.

This Court notes that the amount being one time full payment of the principal sum, the Department will no longer be pursuing its

claim for interest and penalty. This satisfies the case of the Department.

The impugned order (dated 17.12.2003) is accordingly set aside. Petition disposed of in the above terms. INDERMEET KAUR, J JANUARY 18, 2017
