The Petitioner has filed the instant petition, challenging the Look Out Circular (LOC) issued against him by the Respondents on the basis of FIR bearing No. RC2212022E0030 registered by the Central Bureau of Investigation (CBI) on 7th June, 2022.

Cases, arraigning the Petitioner as an accused. 3.

Considering the aforesaid circumstances, the Court is of the opinion that in view of the judgement of this Court in Sumer Singh Salkan v. Asstt. Director,1 the question regarding the legality of the LOCs has to be adjudicated by the trial court where the Petitioner's case is pending, i.e., the CBI Court. Therefore, the Petitioner should approach the said court to make a request for permission to travel abroad or for cancellation of the impugned LOC.

The Court has not examined the merits of the case. All rights and contentions of the parties are left open.

The present petition is disposed of with a liberty to the Petitioner to take recourse against the impugned LOC before the concerned court. 6.

With the above directions, the petition is disposed of along with pending application(s).
