A Writ Petition under Article 226 of Constitution of India read with Section 482 of Cr.P.C has been filed on behalf of the Petitioner for quashing of FIR No.221 of 2010 dated 07.10.2010 under Section 323/440 IPC registered at Police Station Patel Nagar on basis of a Settlement dated 23.01.2021.

It is submitted that after having entered into the Settlement, the Complainant is not forthcoming and therefore, the Petitioner is seeking adjournment for arguments for quashing of FIR in terms of the Settlement. 3.

It is a case of 2010. The parties may have entered into the Settlement, but since then the entire evidence has been recorded including that of the Complainant.

There is no merit in quashing of the FIR on the basis of the Settlement especially when the entire Prosecution Evidence has already been led. 6.

The Petition is hereby dismissed.
