Petitioner has filed the subject petition seeking release of the gold articles seized from Ms. Maktuba Sharipova, who expired on 11.12.2023.

The petition has been filed in the name of the husband of the daughter of the deceased based on an authorization given by the daughter.

Learned counsel for the respondent raises a preliminary objection with regard to maintainability of the said petition. He submits that none of the legal heirs of the deceased have filed the subject petition and petition has been filed solely on the basis of an authorization given by one of the daughters of the deceased and that also in the name of the husband, who has been authorized by the daughter.

Learned counsel for petitioner seeks leave to withdraw the petition with liberty to file a petition in the name of the legal heirs as also by impleading all the legal heirs in the petition. 5.
