Through the present applications, the Applicants seek pre-arrest bail in FIR No. 24/2022, registered at P.S. Barakhamba Road for the offences under Sections 420/406/34 of the Indian Penal Code, 1860.1 1 "IPC"

By order dated 31st May, 2022, this Court had granted interim protection to the Applicants, subject to their joining the investigation. Pursuant to the aforesaid directions, the Applicants have joined the investigation, and the interim protection has been extended from time to time and continues to remain in force till date. Although the chargesheet has not been filed to date, the delay is attributable to the fact that the parties were engaged in settlement negotiations before the Delhi High Court Mediation and Conciliation Centre.

The settlement efforts have now fructified, and the parties have entered into a Settlement Agreement dated 4th August, 2025, a copy whereof has been received from the Delhi High Court Mediation and Conciliation Centre. A perusal of the settlement agreement reveals that Mr. Nishant Garg (Applicant in BAIL APPLN. 1705/2022), has signed the said agreement along with the Complainant, Mr. Anil Bansal.

The Complainant, who is present before the Court in person and has been duly identified by the Investigating Officer, confirms the factum of settlement between the parties. He further affirms that the terms of the said settlement are equally applicable to the other bail Applicants, namely, Manish Kumar Garg and Prashant Garg.

In light of the foregoing developments, having regard to the fact that the parties have indeed reached a settlement, the Court finds no reason to keep the bail applications pending. Accordingly, it is directed that in the event of arrest, the Applicants shall be released on bail on furnishing a bail bond for a sum of ₹25,000/- each, with one surety each of the like amount subject to the satisfaction of the concerned SHO, on the following conditions:

The Applicants shall join and cooperate with the investigation as and when directed by the IO;
b.
The Applicants shall not leave the boundaries of the country without informing the IO/ SHO concerned;
c.
The Applicants shall not contact the witnesses or tamper with the evidence in any manner;
d.
The Applicants shall give their mobile numbers to the concerned IO/SHO and shall keep their mobile phones switched on at all times; 6.
In the event of there being any FIR/DD entry/complaint lodged against the Applicant(s), it would be open to the State to seek redressal by filing application(s) seeking cancellation of bail. 7.
It is clarified that any observations made in the present order are for the purpose of deciding the present bail applications and should not influence the outcome of the trial and also not be taken as an expression of opinion on the merits of the case.
