O R D E R

% 05.09.2019 The petitioner admitted before the Trial Court on 16.02.2019 while granting of anticipatory bail that he will transfer two vehicles bearing registration no.UK-07-BL-0005 (Mercedes) and HP-07-D(T)-0735 along with NOC within two months. However, the said order has not been complied with.

Till date, the petitioner is on interim bail. Learned counsel appearing on behalf of the petitioner submits that Mercedes car mentioned above is in the name of the petitioner, however, the said car is being used by the complainant and he is ready to transfer it to her name.

As far as the second vehicle i.e. HP-07-D(T)-0735 is concerned, it is registered in the name of M/s Sumeru Processor Private Limited and the

same company is under liquidation before NCLT, therefore, he cannot transfer the aforesaid vehicle in the name of the complainant. Therefore, he has not complied with the order dated 16.02.2019. Just to get the interim bail from the court, counsel for the petitioner assured the court below that the petitioner shall transfer the two vehicles as mentioned above. The petitioner was aware that the aforesaid vehicle is in the name of aforementioned company, despite that he made a statement before the Trial Court which has not been complied with, thus the petitioner is not entitled for anticipatory bail.

The same is, accordingly, dismissed.
