% 29.04.2024 I.A. 8502/2024 in CS(COMM) 337/2021 The present application has been filed on behalf of plaintiff under Order XXIII Rule 3 read with Section 151 CPC for recording a compromise and granting permission for withdrawal of suit along with pending I.As. Learned counsels for the parties submits that they have reached on a settlement at Delhi Mediation Centre, Patiala House Courts, New Delhi on 18.03.2024.

Learned counsel submits that they have filed the settlement agreement.

Let the settlement agreement be brought on record. Learned counsel for the plaintiff submits that in terms of settlement he has received a sum of Rupees Forty Five Lakhs Only. Learned counsel submits that in terms of the agreement the amount deposited by the intervener vide order dated 23.05.2022. It has been submitted that as agreed upon by the parties the amount was deposited by M/s Global Beverages Group may be released to the plaintiff along with the interest accrued thereon. In terms of settlement agreement, let the amount deposited by M/s Global Beverages Group in terms of order dated 23.05.2022 be released to the plaintiff by the registry along with the interest accrued thereon.

The parties are held bound by the terms and conditions of the settlement agreement dated 18.03.2024 executed between the parties. Court fee be refunded as per rules.

In view of the above, the present suit along with pending application, if any stands disposed of as compromised.
