O R D E R

% 09.05.2017 The petitioner is in custody since 02.12.2015 in a case instituted vide FIR No.1564/2015 dated 01.11.2015 (P.S.Tilak Nagar) for offences under Sections 307/34 of the IPC read with Sections 24/25/54/59 of the Arms Act. One Amanpreet Singh @ Binny is said to have fired at the husband of the complainant leading to injuries on his person and thereafter fled away along with his associate. It is submitted that the petitioner is not named in the FIR but is being prosecuted in this case on the assumption that he accompanied Amanpreet Singh @ Binny while fleeing from the place of occurrence. The entire occurrence took place over parking of a vehicle. The CCTV camera and DVDR shows that the petitioner was present at the place of occurrence and was trying to load a pistol. Apart from this, there is no other material connecting the petitioner with the occurrence.

Regard being had to the fact that the petitioner is not alleged to have fired on the victim and the period of custody, this Court is inclined to release him on bail.

Be it noted that in this case, charges have been framed but no witness has yet been examined.

Let the petitioner be released on bail on his furnishing a bond in the sum of Rs.10,000/- with one surety of like amount to the satisfaction of the Trial Court.

The petitioner shall participate in the trial in right earnest and shall not cause any delay of conclusion of trial. Should he attempt to do so, it would be open for the State to apply for cancellation of his bail. Application is allowed.
