An application has been filed on behalf of the Petitioner seeking preponment of next date.

A Petition under Section 226 of Constitution of India/227 of Constitution of India read with Section 482 Cr.P.C has been filed on behalf of the Petitioner seeking quashing of FIR No.679/2023 under Section 285/337/304A/34 IPC registered at Police Station Samaipur Badli. 5.
The brief facts are that on 24.07.2023 at about 11:00 A.M suddenly one electric wire burnt in the factory of the Petitioner situated at Libaspur, Delhi. work in the factory burnt due to fall of electricity wire upon her. She was taken to BJRM Hospital for treatment. She died during treatment. Three other persons namely Jitender, Rakesh and Dinesh Kumar Yadav received minor while one other boy namely Dablu Yadav suffered fatal injuries in the said incident. The Police registered the FIR No.679/2023 under Section 285/337/304A/34 IPC against the Petitioner.

It is submitted that the Respondents Jitender, Rakesh and Dinesh Kumar Yadav were the employees who were also present in the factory at the time of incident and had received simple injuries. It if further submitted that the Petitioner and respondent No. 2 and 3 namely Jitender and Rakesh have already sorted out their all differences with the intervention of their respective persons of the vicinity vide compromise Deed dated 08.02.2024 and they have left no grudge or grievance against each other in any manner whatsoever.

It is further submitted that Respondent Dinesh Kumar Yadav has also sorted out the differences between him and the Petitioner vide Compromise Deed dated 21.07.2025. All the above three injured have no objection to the quashing of the present FIR.

Vide EAR/01/ND/2023, the matter was settled between the Petitioner and the CEC vide Order dated 20.08.2024 the wife of Anil Kumar Singh namely Ms. Subita died in the incident for which the present FIR was registered. She was survived by her husband Anil Kumar Singh and two minor children who are being represented by him. A total compensation of Rs.6 lakhs has been awarded out of which Rs.2 lakhs each has been put in the name of two minor children while the balance amount of Rs.2 lakhs has been given to Anil Kumar Singh. and coercion has accepted the Compensation amount. He is present in the Court and submits that he has been adequately compensated and does not seek any further compensation and that the present FIR may be quashed against the Petitioner herein.

Similarly, Smt. Lachi Devi and Sh. Sarjan Prasad Yadav the parents of deceased Dablu Yadav in Case No.ECD/90/ND/Lab./2023 vide Order dated 18.07.2025 have also settled the matter with the Petitioner and have accepted a compensation of Rs.6 lakhs voluntarily without any fear, pressure and coercion and have no objection to the quashing of the present FIR. 10.
The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 11.
In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 679/2023 registered at Police Station Samaipur Badli, for offences punishable under Sections 285/337/304A/34 IPC with all the subsequent proceedings and the charge sheet is hereby quashed qua the Petitioner herein.

The Petition stands disposed of.
