The present writ petition has been filed seeking a direction to the respondent-MCD to forthwith stop construction activity at the property bearing no.8094, Main Gali, Chimni Mill, Bara Hindu Rao, Delhi-110006 (hereinafter 'subject property').

Pursuant to the order passed by this Court on 15th May, 2026, the subject property has been inspected by the respondent/MCD. 3.
Counsel for the respondent/MCD submits that the petitioners reside seven (7) houses away from the subject property. He submits that the subject property has been booked for unauthorised construction on 19th May, 2026 and a show cause notice has been issued on the same date. Further, a work stop notice has already been issued on 19th May, 2026 and as on date, no construction is going on.

A copy of the aforesaid show cause notice has been handed over in Court and the same is taken on record.

Since the property of the petitioner is located at a distance from the subject property, in the normal course, this Court would not be inclined to entertain the present writ petition. However, since MCD has already issued the show cause notice and a work stop notice, the present writ petition is disposed of while directing the respondent/MCD to take action in accordance with law.

Counsel appearing for the respondents no.4 and 5 submits that no fresh construction shall be carried out till the adjudication of the show cause notice issued by the MCD.

All rights, contentions and legal remedies of the owner/occupier/private respondents shall remain protected.
