The present Writ Petition has been filed under Article 226 of the Constitution of India, read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce Ms. Jyoti, the wife of the petitioner, who is stated to be missing along with her younger sister.

Pursuant to the notice issued, the respondents have produced Ms. Jyoti before us.

We have interacted with her in our chamber.

had gone along with her sister to stay with her aunt. She further states that she now wishes to return and reside with the petitioner. At the same time, she also expresses apprehension of threat from her family members.

Keeping in view the above, and considering that Ms. Jyoti is a major and is entitled to decide where and with whom she wants to reside, she is permitted to go with the petitioner. 6.

As far as her apprehension of threat at the hands of her family members is concerned, we direct the concerned SHO to share his mobile number, as also the contact details of the Beat Constable of the concerned area where the petitioner and Ms. Jyoti are residing and, in case of any threat, to grant them protection forthwith. 7.

As far as the sister-in-law of the petitioner is concerned, Ms. Jyoti maintains that her sister is staying with her aunt out of her own free will and volition. As the present petition does not make any prayer seeking her production, we would not like to proceed further in this regard.

The present petition is disposed of in the above terms.
