O R D E R

% 26.08.2019 Vide the present petition, petitioner seeks anticipatory bail in rebut of the case FIR No. 65/2018 of PS Badarpur, for the offences under Sections 33 and 58 of the Delhi Excise Act.

Learned counsel appearing for the petitioner submits that he is the owner of the truck and involved in the present case and the said truck was given on rent to one Asif, son of Ayyub Mohammed., resident of Mohra Sahab Ka Gol Hatai, Jahajpur, Bhilwara, Rajasthan and the said truck was driven by one Driver Sunil, who was the employee of Mukesh. Thus, the petitioner has no case.

Keeping in view the fact that the driver was not the employee of the petitioner and the petitioner had given the truck on rent to Asif, which is not disputed by the Investigating Officer, I hereby direct the Investigating officer concerned to release the petitioner, in the event of his arrest, on furnishing a personal bond of Rs. 25,000/- with one surety in the like

amount to the satisfaction of the I.O.

The application stands disposed of.
