Petitioner No.1, who was allegedly brutally assaulted inside the police station premises, prays for conducting a fair, impartial and independent investigation into the incident of alleged custodial violence and assaulted upon him.

It is noticed that he has already moved an application in this regard, which is pending adjudication before the concerned Magisterial Court. He has placed on record a copy of order dated 28.01.2026 but learned Standing Counsel (Crl.), who appears on advance notice, submits that, thereafter, the matter was taken up by the learned Magisterial Court on 16.04.2026 also and he also submits that inquiry is being conducted in a very transparent manner. 3.

After hearing arguments for some time, learned counsel for petitioner submits that he would wait for the outcome of the abovesaid application and, does not press for any relief at this juncture. He supplements if dissatisfied by the outcome thereof, he be given liberty to approach this Court again. before the Police Complaints Authority (PCA). 4.

Petition stands disposed of, as not pressed.

Liberty, as prayed, is granted. All rights and contentions are reserved. 6.

However, at the same time, learned Trial Court is also requested to make best efforts to dispose of the abovesaid application as expeditiously as possible. This Court also expects that the ongoing departmental inquiry would be completely impartial and neutral.
