By virtue of the present writ petition under Articles 226 and 227 of the Constitution of India, read with the provisions of the Trade Marks Act, 1999 seeking following reliefs:

"i.

Issue a Writ of Mandamus or any other appropriate Writ(s), Order(s)/ Direction(s) in the fact and circumstances of the matter thereby directing the respondent No.1 and their subordinate concerned officials to registered the impugned trademarks of the petitioner in the interest of natural justice; ii.

Issue a Writ of Mandamus or any other appropriate Writ in the fact and circumstances of the matter thereby directing the respondents No.1 to set aside his impugned order dated 26/12/2024 and to registered the marks of the petitioner in the register of trademarks, in the interest of justice;

iii.

Our petition be allowed and direct the learned Assistant Registrar of Trademark to proceed further for registration of the impugned Mark.

iv.

Issue any other writ(s), order(s) or directions(s) which this Hon'ble Court may deem fit, just and appropriate in the facts and circumstances of the present case in favour of the and against the respondents."

Learned counsel for the petitioner, after some arguments, seeks to withdraw the present petition with liberty to move afresh before an appropriate forum in accordance with law.

Accordingly, the present petition is dismissed as withdrawn, with liberty as prayed for.

On oral request, learned counsel for the petitioner prays for refund of Court fee.

Considering the aforesaid circumstances, upon the petitioner taking appropriate steps, 100% Court fee be refunded to the petitioner.
