By way of the instant petition, the petitioners are seeking quashing of FIR bearing No.193/2019 dated 30.04.2019, registered at Police Station Mohan Garden, South-West District, Delhi for the commission of offences punishable under Sections 498A/406/34 of the Indian Penal Code, 1860 (hereafter 'IPC').

Issue notice. Mr. Rajkumar, the learned APP accepts notice on behalf of the State.

All the petitioners are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned, from Police Station Mohan Garden, South-West District, Delhi. 6.

Brief facts of the present case are that on 06.12.2011, marriage between petitioner no. 1 and respondent no. 2 was solemnized, according to Hindu rites and ceremonies at Delhi. On 02.06.2013, a child was born out of the said wedlock. However, due to temperamental differences that arose between the parties, both the parties began residing separately since April, 2018. It is stated that on 18.04.2018, respondent no. 2 had filed a complaint against the petitioners, before the CAW cell, which later culminated into the present FIR. It is stated that during the pendency of the case, both the parties have amicably settled all their disputes before the Counselling Cell, Family Courts, Delhi vide Settlement dated 16.10.2023 and had obtained a decree of divorce from the concerned Court.

It is stated that both the parties have amicably settled the present matter vide Settlement dated 16.10.2023, entered between them and their statements to the said effect have been recorded by the learned Joint Registrar (Judicial) on 22.04.2025.

On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. It is also stated by respondent No.2 that the entire dispute has been amicably settled between them vide Settlement dated 16.10.2023 and they had obtained a decree of divorce from the concerned Court. has no objection, if the FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus, be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 10.

Accordingly, FIR bearing no. 193/2019 dated 30.04.2019, registered at Police Station Mohan Garden, South-West District, Delhi for the commission of offences punishable under Sections 498A/406/34 and all consequential proceedings emanating therefrom are quashed. 11.

In view of above, the present petition stands disposed of 12.
