This is a petition seeking direction to the respondent to register an FIR on the basis of complaint dated 26.08.2020.

Learned counsel appearing for the petitioner submits that petitioner is a senior citizen aged about 71 years and is aggrieved by the inaction of Police to register the FIR since last five years. disposed of till date despite the fact that compliant discloses the commission of cognizable offence.

Learned ASC appearing for the respondent submits that the present petition is an abuse of the process of law inasmuch as the petitioner has filed the present petition despite the application under Section 156 (3) Cr.P.C. being still pending before the learned trial Court. He states that present petition is nothing but an arm-twisting exercise to pressurise the Police and trial Court.

He further submits that the allegations made by the petitioner in his complaint are being investigated by the Police in FIR No. 267/2018, registered at Police Station Vasant Kunj at the instance of the brother of petitioner.

Since the application under Section 156 (3) Cr.P.C. is still pending before learned Metropolitan Magistrate, petitioner may pursue his remedies before the same Court. However, considering the fact that no final orders have been passed on such application despite the same being pending for the last five years, the trial Court is requested to make all possible endeavour to dispose of the application as expeditiously as possible. 6.
