The instant petition is for the following reliefs:- "a. Issue any appropriate writ, order or direction, directing the Respondents to include only those Singh Sabha Gurdwaras for draw of lots who is Complying Section 4 of The Registration of Societies Act, 1860 from last four Consecutive years and submitted the list of office bearers to the SDM or Registrar of Societies; b. Issue any appropriate writ, order or direction, directing the Respondent No. 1 to include only those Registered Singh Sabha The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Gurdwaras under the Societies Registration Act, 1860 whose elections are held timely and strictly in accordance with their Memorandum of Association shall be eligible for co-option to the DSGMC; c. Issue any appropriate writ, order or direction directing the Respondents to publish a complete verified list of all Singh Sabha Gurdwaras in Delhi specifying Last election date, whether election was held timely, Whether Section 4 of the Societies Registration Act, 1860 and MoA was followed or not, to be uploaded on the website of Directorate of Gurdwara Elections;
d. Issue any appropriate writ, order or direction directing the Respondent No. 1 do not include those registered Singh Sabha for draw of lots whose elections were not heldas per their MOA as eligible for co-option;
e. Issue any appropriate writ, order or direction directing the Respondent No. 1 do not include those registered Singh Sabha Gurdwaras for draw of lots where elections are challenged and matter is pending;
f. Any other relief that this Hon'ble Court may deem fit and proper in the interest of justice and for the upliftment of the community." 2.
A perusal of the representation dated 09.02.2026, would indicate that the petitioner essentially seeks that the elections of two members to represent the "Singh Sabhas of Delhi" in the Delhi Sikh Gurdwara Management Committee („Committee') under Section 4(b) (i) of The Delhi Sikh Gurdwaras Act, 1971 („the Act of 1971‟), be made only from amongst members, who have complied with the mandate of Section 4 of the Societies Registration Act, 1860 („the Act').

Learned counsel, who appears on behalf of the concerned Registrar on instructions, submits that the same is not his responsibility. According to him, if the petitioner has any grievance with respect to non-inclusion or wrongful inclusion of any Singh Sabha Gurdwara, the remedy would lie elsewhere.

The Court in the instant petition, as of now, is not adjudicating as to whether the names of ineligible Singh Sabha Gurdwaras are included or otherwise. The Court, however, deems it appropriate to direct the concerned Registrar/ Divisional Commissioner to deal with the petitioner‟s pending application with due expedition. If the concerned Registrar/ Divisional Commissioner, finds that the requested exercise cannot be undertaken by him, let specific reasons be assigned to the petitioner. 5.
Let the concerned Registrar/ Divisional Commissioner to deal with the application of the petitioner and to pass appropriate orders within a period of three (3) months from the date of receipt of the copy of this order. 6.
Needless to state that, if the grievance of the petitioner is not fully mitigated, he shall be at liberty to take appropriate recourse in accordance with law.
