Through the present petition, the Petitioner seeks transfer of maintenance petition bearing No. MT Case No. 286/2024 from the Court of Principal Judge, Family Court, North District, Rohini Courts to another Court within the same district.

The proviso of Section 447(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023,1 clearly provides that no application shall lie to the High Court for transferring a case from one Criminal Court to another Criminal Court in the same sessions division, unless an application for such transfer has been made to the Sessions Judge and rejected by him. 3.

In light of the above, counsel for the Petitioner states that she would like to withdraw the present petition and take recourse to the appropriate 1 "BNSS"
