The learned counsel for the petitioner submits that the matter is now fixed for the examination of the alleged eyewitness, namely, Pushpa. He submits that he has been falsely implicated in the present case and the alleged eyewitness gave her statement after eight months of the incident. He submits that there is no recovery from the applicant and he is in incarceration for the last more than six years. He further submits that even though the alleged eyewitness had appeared for recording of the evidence, but the learned Trial Court was on leave on last three occasions.

He seeks liberty to withdraw the present application and to file afresh after the examination of the eyewitness namely, Pushpa.

The learned Trial Court is requested to expedite the examination of the remaining witnesses.

In view of the above, the application is dismissed as withdrawn with the aforesaid liberty.
