However, despite service, the respondent has not come forward or raised any objection.

The arbitration clause in the Agreement provides for appointment of a Tribunal of three Arbitrators. The petitioner has filed the above review application only by way of abundant precaution so that an objection may not be raised that the order appointing a Sole Arbitrator is contrary to the arbitration clause.

Mr. Raj Kumar, learned counsel for the petitioner, however states that the petitioner has no objection to the appointment of a Sole Arbitrator as that will save cost of the arbitration process. 8.
Since, the respondent is not appearing, with the consent of petitioner, the matter is referred to the Sole Arbitrator only. 9.
