The present petition filed under Article 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (formerly Section 482 of the Code of Criminal Procedure, 19732) inter-alia seeks quashing of FIR No. 0120/2025 registered under Sections 305(c) of the Bharatiya Nyaya Sanhita3, at P.S. New Ashok Nagar and all consequential proceedings emanating therefrom. In addition, he requests for a direction that no coercive action, including arrest, be taken against him. 2.

It is noted that the Petitioner had earlier filed an application, seeking anticipatory bail through Bail Application bearing no. 1371/2025 titled 1 "BNSS"

The Petitioner, instead of filing another bail application, has filed the instant petition seeking quashing of FIR and a direction for protection from arrest under article 227 of the Constitution read with section 528 of the BNSS.

After making some submissions, Mr. Aviral Saxena, counsel for Petitioner states that he would like to withdraw the present petition and take recourse to appropriate legal remedies as are available under law. 5.

Dismissed as withdrawn with liberty as aforesaid. The Pending applications also stand disposed of.
