On previous date of hearing, the following order was passed:- "1.
The Petitioner's bid has been rejected on the ground of pendency of FIR No. 10/2024 registered against the Petitioner at Police Station Anti-Corruption Branch under the provisions of Prevention of Corruption Act, 1988.

The learned senior counsel representing the Petitioner submits that two different Division Benches of this Court have formed separate opinion with regard to legality of a similar clause stipulating ineligibility of a bidder if any FIR is registered against it.

The notice inviting tender was issued on 15.01.2026. The Petitioner on that day knew that it is not permitted to participate. After having participated and on being rejected, the Petitioner has filed the present writ petition in mid of May, 2026. It is informed that the financial bids have already been opened, hence, this Court is not inclined to grant interim order in favour of the Petitioner. 4.
However, in order to examine the judgments which have been brought to the notice of this Court, list on 18.05.2026."
