JUDGMENT

SANJEEV SACHDEVA, J. (ORAL) CM APPL.1229/2021(for early hearing and final disposal) 1.

The hearing was conducted through video conferencing. 2.

By this application, the parties seek final disposal of the petition.

With the consent of the parties the petition is taken up for consideration today.

The application is, accordingly, allowed in the above terms.

The next date of 17.02.2021 is cancelled.

Petitioner by this Petition seeks a direction to the respondent/State Transport Authority to revoke and clear the taint of blacklisting and the bar/restriction imposed on sale of vehicle Ferrari 458 Italia registered vide registration No. DL-8C-T-1313. 2.

Mr. Sanjoy Ghose, learned Standing Counsel appearing for the respondent submits that the embargo was imposed as an email has been received from the State Bank of India in respect of the said vehicle and accordingly, a blacklisting was issued to the said vehicle. 3.

Learned counsel appearing for the State Bank of India submits that the loan accounts of Mr. Chhabria has been settled and further there are no dues insofar as the said vehicle is concerned and the bank has no objection in case the blacklisting of the vehicle and the restriction imposed on the sale of the vehicle is lifted. 4.

In view of the above statement, learned counsel for the respondent submits that appropriate action in accordance with law will be taken within one week. The statement is taken on record. 5.

The petition is accordingly disposed of in terms of the statement given by learned counsel for the respondent and directing the respondent to revoke and clear the taint of blacklisting and the

bar/restriction imposed on sale of vehicle Ferrari 458 Italia registered vide registration No. DL-8C-T-1313. Needful be done within one week.
