The present application has been filed on behalf of the petitioner for withdrawal of the present writ petition.

It is submitted that the present writ petition had been filed with regard to the illegal and unauthorized construction in the property bearing no. H-5, Netaji Subhash Place, Pitampura, Delhi-110034. 3.

Learned counsel appearing for the petitioner submits that prior to the institution of the present writ petition, the Delhi Development Authority ("DDA") had already passed a Demolition Order dated 31st May, 2022, in respect of the subject property.

It is further submitted that vide order dated 24th April, 2024, passed in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

W.P.(C) 5691/2024, this Court has already directed that no coercive steps shall be taken against the subject property.

Further, the petitioner has also instituted civil proceedings in respect of the subject property, being CS(COMM) 671/2025 and CS(COMM) 921/2025, which are pending before this Court. 6.

Thus, it is submitted that in view thereof and that since there is initiation of sealing/demolition action against the subject property, the present petitioner seeks withdrawal of the same, while reserving the liberty to pursue his remedies, in accordance with law. 7.

Learned counsel appearing for the petitioner also draws the attention of this Court to the reply/counter-affidavit of respondent no. 3 to the present petition, wherein, respondent no. 3 has stated that it has not carried out any addition/alteration in the property in question. Para 19 of the reply of respondent no. 3, reads as under:

19. It is submitted that the answering respondents have replied to the letter-cum-order dated 31.05.2022 passed by Respondent No.2 ordering demolition of the property in question. The answering respondents have categorically responded to the said order stating its version. They have informed the respondent no.2 that no changes or addition, alteration have been made in the building as alleged except the permissible repairs and renovation as per the unified building bye laws. The answering respondent in the most bona fide manner even requested for a 60-day timeline to bring the existing structure within the norms, if any flouted as per the prevailing master plan and the requirements mentioned by Respondent No.2.

The answering respondent also conveyed that the nature of changes asked to be made cannot be completed within 7 days.

Learned counsel appearing for the DDA submits that the DDA has no objection if the present writ petition is withdrawn. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Considering the submissions made before this Court, the present writ petition, along with the pending applications, is dismissed as withdrawn. 10.
