Learned counsel for respondent appears on service and apprises that the appeal filed by the petitioner herein has already been dismissed on 13.05.2024 by the learned First Appellate Court and the petitioner herein has already filed a Regular Second Appeal before a co-ordinate Bench of this Court which is listed for today only.

The grievance in the present petition is with respect to dismissal of the application moved by the petitioner under Order XLI Rule 27 with respect to the same appeal whereby he wanted to lead additional evidence. 3.
