The present Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the petitioners seeking to quash the FIR No. 0001/2019 registered under Sections 406/409/420/120B of Indian Penal Code, 1860 at Police Station Economic Offence Wing, Delhi.

This is a case in which the petitioners are the Builders in whose project, 399 people have booked their flats, however, the said project could not be completed in time and, therefore, the complaints have been filed by those people who have booked the flat with Economic Offences Wing, Delhi.

It is submitted on behalf of the State that the main Chargesheet has been filed, though further investigations are still continuing in respect of which, a Supplementary Chargesheet shall be filed for framing of charge before the learned Trial Court.

In view of above, no directions are required to be passed in the present petition, which is hereby dismissed along with pending application. 5.

However, the petitioners are at liberty to address the arguments on non-maintainability of Charges or to pursue any other remedy so available in regard to filing of the Chargesheet as per law, before the learned Trial Court/Competent Authority.
