O R D E R

The petitioner has filed the present petition being aggrieved by the fact that the representations dated 26.02.2025 and 07.04.2025 submitted by the petitioner to the concerned respondents, have not been decoded. The same raises a grievance as regards two surviving member certificates being issued in favour of her brother Mr. Pawan Gupta. 2.

It is submitted that the said Mr. Pawan Gupta has obtained two surviving member certificates from two different districts, bearing Nos. 90660000201500 dated 14.08.2023 issued by respondent no.1 and 90660000205495 dated 19.09.2023 issued by respondent no.3, by playing fraud and forgery and concealing the correct facts. 3.

It is submitted that Mr. Pawan Gupta was disowned by the petitioner's late father namely Mr. Yatender Prakash Gupta and a public notice to this effect was also published in a local newspaper on 08.06.2016 in the lifetime of the petitioner's father. It is submitted that the petitioner's brother continued to be estranged from her father till latter's demise on 05.08.2023. It is pointed out that the aforesaid complaints/representations submitted by the petitioner sets out the relevant factual background and call upon the respondents to take necessary action. It also seeks that the respondents take requisite steps to prevent registration of any document for sale/purchase of any property on the basis of the said surviving member certificates.

After some hearing, with the consent of the respective counsel for the parties, the present petition is disposed of with a direction to the concerned Authorities/SDM to decide the aforesaid representations/complaints of the petitioner. For this purpose, the concerned SDM shall afford an opportunity of hearing to the petitioner and also to the brother of the petitioner i.e. Mr. Pawan Gupta.

It shall be open for the SDM to request the Sub-Registrar to ensure that the surviving member certificates bearing Nos. 90660000201500 dated 14.08.2023 and 90660000205495 dated 19.09.2023 shall not be used for the purpose for undertaking any property transaction/s on the basis of the said certificates.

Let the matter be considered by the concerned SDM expeditiously, and the petitioner's complaints/representations be disposed of as expeditiously as possible, preferably within a period of 12 weeks from today.

The petition is disposed of in the above terms. Pending applications also stand disposed of.
