% 24.01.2017 The learned counsel for the respondent has taken instructions. He informs us that the Request for Proposal was initiated on 02.01.2017 on which date the petitioner was no longer a licensee inasmuch as its licence for Food Plaza was till 31.12.2016. It was also not an NRC empanelled party and it is for this reason that the RFQ was not issued to the petitioner. The learned counsel for the respondent further states that the regular tender would be floated in which all eligible parties would be able to participate. Till that is done, the present RFQ is only a bridge between the expiry of the previous licence and the establishment of a new licence. He further submits that the tender is likely to be floated within a period of six weeks from today.

In view of these submissions, the learned counsel for the petitioner does not press this writ petition any further.

The writ petition stands dismissed as not pressed in the aforesaid circumstances.
