O R D E R

% 06.03.2024 1.

Present petition under Article 226 of the Constitution of India Read with Section 482 of the Code of Criminal Procedure seeks the following prayers:

"a) Issue a writ of certiorari and/or any other appropriate writ, order(s), direction(s) thereby allowing the present petition and quashing/settingaside the impugned order dated 31.05.2017 passed by Shri Sunil Kumar, Metropolitan Magistrate, District North, Rohini Courts, Delhi, having been passed exceeding and beyond the territorial jurisdiction, consequently Quashing of Zero F.I.R. registered by P.S. Model Town on 09.06.2017 and resultantly the F.I.R. No. 0245 of 2017 registered by P.S. Moti Nagar, New Delhi; alongwith Quashing of all consequential orders still being passed by the Ld. Court of MM, Model Town. b) Call for the record of Ld. M.M, P.S. Model Town. c) Call for the record of zero FIR registered by P.S. Model Town and quash the same.

d) Call for the FIR No. 245/2017 registered by P.S. Moti Nagar and quash the same.

e) Award compensation to the petitioners for unnecessarily dragging them into the present litigation;

f) Grant any other, further, relief, which this Hon'ble court deems fit and proper, with regards to the submissions, facts and circumstances of this matter, so as to be in the interest of justice as well as in the interest of petitioner."

Learned Additional Standing Counsel submits that the closure report has been filed with regard to the present FIR. 3.

Learned counsel of the petitioner seeks leave to withdraw the present petition with liberty to initiate proceedings in accordance with law if the need arises.
