O R D E R

% 12.09.2025 I.A. 22670/2025 (Under Order XXIII Rule 3 CPC) 1.

This is a joint settlement application filed under Order XXIII Rule 3 of Code of Civil Procedure, 1908 ['CPC'] for recording the settlement arrived between the parties and seeking passing of a decree based on the said settlement in the captioned suit.

The application is duly signed by the parties and is supported with their affidavits.

Learned counsel for the parties jointly state that the terms of the settlement are set out in paragraph nos. 5 and 6 of this application. 3.1 They jointly pray that in terms of the settlement, the counter-claim bearing CC(COMM) 12/2025 and the contempt petition bearing CCP (O) 22/2025, be also disposed of.

XXIII Rule 3 CPC.

This Court has heard the learned counsels for the parties and also perused the settlement terms and conditions set out in this application. The Court is satisfied that the said settlement satisfies the requirements of Order XXIII Rule 3 CPC. The settlement terms and conditions contained in the captioned application is lawful and therefore, there is no impediment in decreeing the suit in terms of the settlement arrived between the parties. 6.

Consequently, the application is allowed, and the settlement terms are taken on record.

Accordingly, the underlying suit and the counter-claim bearing CC(COMM) 12/2025 is disposed of in view of the settlement terms and conditions set out in the captioned application. 8.

The contempt petition bearing CCP (O) 22/2025, is disposed of as not pressed.

The Registry of this Court is directed to draw up a decree-sheet in terms of this order. The settlement terms and conditions set out in paragraph nos. 5 and 6 of the captioned application shall form part of the decree. 10.

Interim orders, if any, stand merged into the final decree. 11.

Pending applications are disposed of.

12.

Future dates stand cancelled.

Refund of Court Fees 13.

Learned counsel for the parties jointly request that in view of the compromise recorded between the parties and the early disposal of the suit, the court fees deposited in the suit and counter-claim, maybe refunded. They state that they will be satisfied with a partial refund. 14.

Keeping in view the aforesaid facts, the Registry is directed to refund The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

50% Court Fee in favour of the plaintiff deposited in the underlying suit and 50% Court Fee to the defendant deposited in his counter-claim, within four

(4) weeks, in accordance with the law.

The said direction has been passed having regard to Section 16 and 16A of the Court Fees Act, 1870 (as applicable to Delhi). 16.
