3. Learned counsel named above accepts notice on behalf of the respondent.
4. The e-copy of the petition be supplied to the learned counsel for the respondent by the petitioner through email during the course of the hearing. The case is passed-over for her to obtain instructions. Having done so, she sates upon instructions, that whatever has happened in the past was only an expression of the respondent‟s public spiritedness and her concern for sharing what she thought was right;
her expression should not be construed as being actuated by malice against the appellant. She states that she cannot retrieve her posts that are in the public domain. Now she would rather put all that behind her. She states that: i) without prejudice to her rights and contentions, ii) to freedom of expression and iii) to her right to make fair comment, she would in the spirit of live, she would refrain from posting anything, which could be construed as malicious or defamatory apropos the appellant. In the same breath though, she would expect the appellant to carry all his duties as would be befitting as former soldier and a gentleman.
5. The learned Senior Advocate for the appellant submits that the aforesaid proposal is acceptable to the appellant.
6. In view of the above, the appeal, alongwith pending application, is disposed-off in terms of the above. Accordingly, the appellant undertakes to withdraw the pending suit.
