The present bail application has filed seeking anticipatory bail in FIR No. 126/2019 registered under Section 380 IPC at P.S. Jahangir Puri. 2.

As per the prosecution case, the applicant, who was a tenant, committed a theft of Rs.70,000/- from the house of his landlord. 3.

Learned counsel for the petitioner submits that initially the interim protection was granted to the petitioner on his undertaking to deposit Rs.70,000/-, which was later on permitted to be paid by way of instalments. Learned counsel further submits that he has no instructions in the matter and despite communicating to the petitioner that the directions contained in the previous order have not been complied with, the petitioner has not come forward to comply with the same.

Learned APP, on the other hand, submits that the proceedings under Section 82 Cr.P.C. were initiated against the petitioner. However, despite the interim protection granted by this Court and the directions to join the investigation, the petitioner has failed to join the investigation even once.

She, on instructions, further submits that even the petitioner is not available at his Delhi address as well as permanent address i.e., Ambedkar Nagar, Uttar Pradesh.
