This petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), praying for issuance of a Writ in the nature of Habeas Corpus for production of the husband of the petitioner no. 1 and father of the petitioner no. 2, Sh. who is alleged to be in illegal confinement of respondent no. 4, his son.

Admittedly, the corpus has been residing at Haridwar, Uttarakhand, and has continuously stayed there. In view thereof, we are of the opinion that this Court lacks the territorial jurisdiction to entertain the present petition.

Accordingly, we dispose of the present petition by reserving liberty with the petitioners to avail of their remedies in accordance with law before the appropriate Court.
